Recently, a mid-40s worker was driving and happened to bump the car in front of him. Unfortunately, he left the scene, which qualifies as hit and run – a Class 1 misdemeanor in the Commonwealth of Virginia. He was charged in Roanoke City General District Court and was worried about his prior criminal history. Having a hit and run conviction on his record would haunt him, leading to a potential loss of driving privileges and employment.
He came to Copenhaver, Ellett & Derrico to see what we could do to help him. We assured him that the Commonwealth bore the burden of showing that he possessed knowledge of injury or property damage. We attended one court date on his behalf, and we were able to negotiate the charge down to a Class 4 misdemeanor with just a $100 fine. The client pled no contest and was able to maintain his driving privileges and employment.
