A truck driver in his mid-40s was recently charged with following too closely, a Virginia traffic citation that carries three (3) demerit points, in Pittslyvania County. At the time of the incident, a car turned without signaling from a two-lane road. The truck slammed on its brakes, but could not stop in time and rear-ended the car in front of him.
Since he drives for a living and holds a commercial driver’s license (CDL), the man was extremely worried about his employment. On top of that, he had also had a recent spell of multiple traffic charges across several jurisdictions. He hired Roanoke traffic lawyers Copenhaver, Ellett & Derrico to handle his case. Attorney Cerid Lugar represented him on one court date. After reviewing the evidence against the man, her defense focused on how he had maintained a reasonable and prudent distance between cars given the road conditions and amount of traffic. She also pointed to the unexpected action taken by the other vehicle.
Ultimately, the Commonwealth Attorney agreed to dismiss the case. This was important, since there is also a civil personal injury suit pending against the man.
Case results depend upon a variety of factors unique to each case. Case results do not guarantee or predict a similar result in any future case.
