Appeal Pending on Driving With a Suspended License, Concealed Weapons Charges

Our client was a manufacturer/laborer in his 30s who was charged with driving with a suspended license and a concealed weapons offense. Both are Class 1 Misdemeanors with the possibility of jail time and fines. Our client was charged after a police officer found him asleep behind the wheel at a designated pull off. The officer discovered that our client had a suspended driver’s license and found a gun in the center console of the vehicle.

The criminal and traffic defense lawyers at Copenhaver, Ellett & Derrico represented the man on the driving with a suspended license and concealed weapons charges. He had a previous charge for reckless handling of a firearm. We appealed the conviction from the Circuit Court of Floyd County, and two assignment of errors have been accepted by the Virginia Court of Appeals for consideration. The appeal remains pending.
