Montgomery County Circuit Court

We have represented clients for all types of criminal cases in Montgomery Circuit Court over the last 50 years. The Commonwealth’s Attorney for Montgomery is Mary Pettitt, and she, along with court clerk Erica Williams, ensure that cases are prosecuted and handled fairly.

Circuit court terms begin the second Tuesday in January, April, July, and October, and court convenes at 9 a.m. Grand juries are convened on the second and fourth Tuesday in January, April, July, and October. If you are appealing to Montgomery Circuit Court, misdemeanor appeals are pre-set with the Commonwealth’s Attorney’s secretary for the second day of term. If you’ve retained a defense attorney for your appeal, he or she will likely coordinate with the Commonwealth’s Attorney to handle this.

To request a continuance in Montgomery Circuit Court, contact your defense attorney to initiate the request. If you have elected not to hire representation, you can write a letter to the judge who is handling your case with the reason for a continuance request.

If your case has been certified to a grand jury and you’re represented by a defense attorney, you do not need to be present for the grand jury. However, if you’re not represented, you must be present.
